Title card from the "Hootenanny" TV show. Used as an illustration, solely for educational purposes, with the entry on the "Hootenanny" TV Series. Used without excerpt of the accompanying sound track. Image was taken from an episode originally broadcast on October 12, 1963, and not officially registered for copyright. Based on the US Copyright guideline that the broadcast date serves as a "publication date" (and thus the effective date of copyright) when no actual registration occurs; a) the aforementioned date is prior to January 1, 1964, which is the effective date that proactive copyright renewal is no longer required; and b) a proactive renewal was never submitted for this broadcast. It is therefore likely that there are no rights holders to this specific broadcast. Notwithstanding the previous conclusion, it is recognized that a copyrighted video, "Best of HOOTENANNY" from Shout Factory, was released in 2007, and that Shout Factory may be considered a rights holder. In the event, this specific image does not derive from, nor is it included in, the aforementioned copyrighted video release "Best of HOOTENANNY," but was derived from a private source. It is a single image ("frame capture") from a program that consisted primarily of music performances, and as such represents less than 1% of the program's content. For that reason, the use does not detract from any commercial value, if any, for the program itself, nor does it infringe on the rights holders, if any, of the program.
